      No J Class

No J Class this year at Evans, GA due to age limit law for operating a power boat.

Just about every state has laws like this. In Florida the minimum age is 21 yrs. old to operate a boat unless you passed the boater course and receive a license.
States requiring licenses accept licenses from other states and there is not an age limit on getting one. My 11 yr. old son has one from Florida and it is good in Georgia! So if everyone would get one from there respective state J could race.

West Virginia has the same law, so all the kids better watch out if the folks in uniform show up at Hinton this weekend!

You might want to give Mel Thomas a call.

This is not correct with West Virginia., They have an exception for closed course sanctioned racing. I set-up the Hinton race and worked entensively with DNR and USACE.

                  The WVDNR link: http://www.wvdnr.gov/lenforce/prohibited.shtm

Please note the last entry; "The prohibitions listed in this section do not apply to participants in an approved and permitted regatta, race, marine parade, tournament, or exhibition."

Does Georgia have this exception? The call I received said no J class for Evans; this was from a CVRA official.

Please see the information below that I received in an email last week. These are new laws that were passed in Georgia that will affect the J classes this year (as well as any other racer under the age of 16) & will affect all racers next year. Mel Thomas has spoken with the DNR and it appears there is nothing we can do about it this year. It is very unfortunate and I am sorry for all of the J drivers that planned to attend that will not be able to race at Evans.

                    Effective for 2013
                    Who Can Operate a Boat
Those less than 12 years of age:
May not legally operate a Class 1, 2, or 3 boat or a Class A boat powered by a motor of more than 30 horsepower

May legally operate a Class A boat which is either non-motorized or powered by a motor of 30 horsepower or less only if they are accompanied by a competent adult

Those 12 through 15 years of age:
May legally operate any Class A vessel or PWC only if they:
                    - Have passed a boating safety course approved by the Department of Natural Resources
                    - Are accompanied by a competent adult

May not legally operate any Class 1, Class 2, or Class 3 vessels.

Those 16 years of age or older:
May operate any boat on the waters of Georgia if they have proper identification onboard

                    Effective 2014
All operators born after January 1, 1998 must have passed a boater education course approved by the Department of Natural Resources and have card on board to operate any vessel.

Note- "Competent Adult" means a person of age 18 or older who is not under the influence of alcohol or drugs and who is carrying proper identification.
"Proper Identification" means a drivers license (or legible copy) or any other government issued identification that contains a description of the person, a photograph and birthdate.

I also looked up the Summary of Legislation Enacted During the 2013 Georgia General Assembly to confirm...

SB 136 "Kyle Glover Boat Education Law" and "Jake and Griffin BUI Law"; provide for greater public
                    protection for hunting and boating
                    Miller, Butch 49th
Approved by the Governor 4/23/13; effective 5/15/13.
SB 136 extensively revises boating safety laws and the boating and hunting under the influence
statutes. For both hunting and boating, the Bill lowers the legal alcohol limit to 0.08 (identical to the
driving limit), updates the applicable implied consent language, and conforms the applicable implied
consent warnings to the language used in the driving context. The Bill also allows law enforcement
officers to obtain the bodily substances of suspected offenders for chemical testing purposes with
voluntary consent or a search warrant (as permitted for driving under the influence).
The periods of suspension for hunting and boating privileges based upon refusal to submit to chemical
testing and for convictions based upon an unlawful alcohol concentration are lengthened by the
legislation, and reinstatement of those privileges is conditioned upon completion of a substance abuse
risk reduction program. In addition, the penalties for boating under the influence are amended to mirror
the penalties for driving under the influence (i.e., 1st and 2nd convictions in ten years are
misdemeanors; 3rd is a high and aggravated misdemeanor; and 4th is a felony).
The required age for children to wear personal floatation devices on boats is raised to 13. The age for
personal watercraft operation and vessel operation on the waters of the State is raised to 16, with
provisions made for persons ages 12-15 to operate such vessels if supervised by an adult over age 18
or after completion of an approved boating safety course. Finally, the Bill requires persons age 16 and
younger to complete a boating safety course before being permitted to operate a vessel on the waters
                    of the State.

If Mel has time, he should contact DNR and show them the WVDNR site listing the exception and then see if Georgia DNR will authorize a one time waiver covering closed-course, insured and sanctioned race/regatta for this year's race.

                      Just a thought.

According to the Georgia law above, a valid operator license from another state that is
recognized by Georgia to be acceptable is good. So my 12 year old son could race.

Persons under the age of 16 cannot operate a boat unless there is an adult in the boat with them.
